ZBA approves permits

SIDNEY —The Sidney Zoning Board of Appeals granted conditional use permits for Brian’s Towing & Recovery and St. Paul’s United Church of Christ on Monday.

The board approved Brian’s Towing & Recovery’s request for a conditional use permit for outdoor storage at 1283 Wapakoneta Ave. in the community business district, after Board Chair David Fleming asked the owner, Brian Winemiller, if he intended to screen more than just the required west side of the business with a fence. Winemiller said he would probably erect a wooden fence around the entire premises and told the board he keeps his stuff picked up.

Also approved was the request of St. Paul’s United Church of Christ for a variance to construct an accessory building in the side yard, and a request for a conditional use permit for an accessory structure square footage over 1,000 square feet per section at 707 N. Ohio Ave. in the single and two-family residence district.

No action was taken to revoke a permit that was granted with the condition of a satisfactory four month review of a conditional use permit requested by Houston Owens for outdoor storage at 1135 Wapakoneta Ave. in the community business district. In November, the board granted the request upon the contingency that Sidney Tool Rental was in compliance at the review in March.

Beyond the typical permit requirements, the request was granted upon the following conditions being met:

• No storage of junked motor vehicles or motor vehicle parts shall be permitted;

• Ingress and egress to the storage area must be maintained meeting the fire department requirements;

• The business owner must erect a 6-foot privacy fence as a barricade.

• The board will review compliance of the permit’s conditions in four months.

In November the business was given 30 days to clean-up the “junk” on the outside of the business. Community Services Director Barbara Dulworth said the business cleaned up the junk and became in compliance in February.
