SIDNEY – The Shelby County Common Pleas Court recently handed down several sentences for attempted felonious assault, failure to provide change of address, theft and drugs, among other charges.
Joshua A. Elliston, 48, of Sidney, was sentenced to 36 months in prison, consecutive to his current sentence, with 18 days of jail credit granted, on one count attempted felonious assault, a third degree felony. Elliston was indicted on one count felonious assault, a second degree felony, one count attempted rape, a second degree felony, and one count kidnapping, a second degree felony, for striking an adult female victim in the head with a baseball bat and punching her multiple times with his fist in her face, attempting to engage in sexual conduct by force with an adult female victim, and restraining the liberty of an adult female victim by threating to kill her while brandishing a baseball bat. Two counts were dismissed.
Robert E. Cooper, 55, of Celina, was sentenced to continue his community control sanction after violating the terms and conditions. Additionally, Cooper must successfully complete in-patient mental health treatment at Dettmer, and once released he is to continue counseling. Cooper was convicted on one count disseminating matter harmful to juveniles, a first degree misdemeanor, for sexual conduct with a minor over the age of 13.
Thomas J. Webb, 37, of Sidney, was sentenced to five years community control, with three days of jail credit granted, on one count attempted failure to provide change of address, a fifth degree felony. Additionally, Webb must successfully complete Thinking for a Change/Decision Points, must successfully complete drug and alcohol counseling, and must obtain a G.E.D. Webb was indicted on one count failure to provide change of address, a fourth degree felony, for failure to notify the Shelby County Sheriff’s Office of a change of address, having previously been convicted or gross sexual imposition.
Penny A. Lucente, 49, of Jackson Center, was sentenced to community control not to exceed five years, with no days of jail credit granted, on one count theft, a first degree misdemeanor. Additionally, Lucente must work with the adult probation department on a regular payment schedule to make restitution. Lucente was indicted on one count theft, a fourth degree felony, for stealing rental income from an adult male victim in an amount between $7,500 and $150,000.
Jeffery J. Schwartz, 34, currently in the Shelby County Jail, was sentenced to 180 days in the Shelby County Jail, with 70 days of jail credit granted, on one count domestic violence, a first degree misdemeanor. Schwartz was indicted on one count domestic violence, a third degree felony, for causing physical harm to an adult male victim by swinging a knife at the victim, scratching and hitting the victim in the face, having previously been convicted on domestic violence.
Devon M. Wita, 23, of Houston, was sentenced to five years community control, with 76 days of jail credit granted, on one count domestic violence, a fifth degree felony and one count aggravated possession of drugs, a fifth degree felony. Additionally, Wita must successfully complete treatment at a community based correctional facility, must successfully complete drug and alcohol counseling, must successfully complete
Batterer’s Intervention, must successfully complete Thinking for a Change/Decision Points, must successfully complete anger and rage counseling, and must obtain a GED. Wita was indicted on one count domestic violence, a fifth degree felony, one count aggravated possession of drugs, a fifth degree felony, and one count possessing criminal tools, a fifth degree felony, for knowingly causing physical harm to a female family member, knowing the victim was pregnant, methamphetamine, baggies, a container and a pipe. One count was dismissed.
Nathan A. Paulus, currently in the Shelby County Jail, was sentenced to 30 months and 11 months in prison, concurrent, and 11 months and 18 months concurrent with each other but consecutive to the first set, with 511 days of jail credit granted, after violating terms and conditions of his community control sanctions. Paulus was convicted on one count aggravated possession of drugs, a third degree felony, one count possessing criminal tools, a fifth degree felony, one count trafficking in drugs, a fifth degree felony, and one count aggravated trafficking in drugs, a third degree felony, for methamphetamine, a baggie, and fentanyl.
April A. Hecht, 39, of Sidney, was sentenced to serve 117 days in the Shelby County Jail, with no days of jail credit granted, on work release after violating terms and conditions of her community control sanction. Hecht was convicted on one count aggravated possession of drugs, a fifth degree felony, for methamphetamine.
Hope Carpenter, 39, currently in the Shelby County Jail, was sentenced to 24 months in prison, with 134 days of jail credit granted, on one count aggravated trafficking in drugs, a third degree felony. Carpenter was indicted on one count aggravated trafficking in drugs, a third degree felony, one count tampering with evidence, a third degree felony, and one count possessing criminal tools, a fifth degree felony, for methamphetamine, hiding a bag of methamphetamine in her body cavity to impair its availability as evidence, bags and pipes. Two counts were dismissed.
Sasha Nelson-Greer, 35, of Chicago, Illinois, was sentenced to five years community control, with 13 days of jail credit granted, on one count of deception to obtain dangerous drugs, a fifth degree felony, and one count possession of drugs, a fourth degree felony. Additionally, Nelson-Greer must successfully complete treatment at a community based correctional facility and must successfully complete other drug, alcohol and mental health counseling. Nelson-Greer was indicted on two counts deception to obtain dangerous drugs, a fifth degree felony, and two counts possession of drugs, a fourth degree felony, for by deception procuring promethazine with codeine, a Schedule V controlled substance, and possession of the same drug. Two counts were dismissed.
