Shelby County Common Pleas issues sentences for aggravated assault, other charges

SIDNEY — The Shelby County Common Pleas Court recently handed down several sentences for attempted aggravated assault, attempted domestic violence, and drugs among other charges.

William C. Barnett, 57, of Sidney, was sentenced to five years community control, with three days of jail credit granted, on one count attempted aggravated assault, a fifth degree felony.

Additionally, Barnett must successfully complete treatment at a community based correctional facility (CBCF), after completion of the CBCF must reside in a recovery home, must successfully complete drug, alcohol and mental health counseling, must successfully complete anger and rage counseling, and must successfully complete Thinking for a Change/Decision Points.

Barnett was indicted on one count felonious assault, a second degree felony, for stabbing an adult male victim multiple times with a knife.

Steven E. Paulus, 23, of Sidney, was sentenced to nine months in prison, with one day jail credit granted, on one count attempted domestic violence, a fifth degree felony. Paulus was indicted on one count domestic violence, a fourth degree felony, for striking a female family member with whom he was cohabitating in the face with his fist, after a previous conviction.

Victoria B. Brussell, 44, of Minster, was sentenced to five years community control, with 16 days of jail credit granted, on one count attempted grand theft of a motor vehicle, a fifth degree felony. Additionally, Brussell must successfully complete treatment at a community based correctional facility (CBCF), after completion of the CBCF must successfully complete a sober living facility, and must successfully complete drug, alcohol and mental health counseling. Brussell was indicted on one count grand theft of a motor vehicle, a fourth degree felony, and one count operating a motor vehicle without a valid license, a first degree misdemeanor, for stealing a 2004 Chevrolet Avalanche and operating a motor vehicle without a valid driver’s license. One count was dismissed.

Jimmy D. Phelps, 45, of Sarasota, Florida, was sentenced to five years community control, with three days of jail credit granted, on one count attempted illegal conveyance of prohibited item onto grounds of detention facility, a fourth degree felony. Additionally, Phelps must successfully complete treatment at a community based correctional facility, must successfully complete drug, alcohol and mental health counseling, and must successfully complete Thinking for a Change/Decision Points. Phelps was indicted on one count illegal conveyance of prohibited item onto grounds of detention facility, a third degree felony, for knowingly conveying Fentanyl into the Shelby County Jail.

Alysa C. Bell, 28, of Sidney, was sentenced to five years community control, with no days of jail credit granted, on three counts trafficking in drugs, a fifth degree felony, and three counts aggravated trafficking in drugs, a fourth degree felony. Additionally, Bell must successfully complete drug, alcohol and mental health counseling and must maintain employment. Bell was indicted on 12 counts trafficking in drugs, a fifth degree felony, and three counts aggravated trafficking in drugs, a fourth degree felony, for Fentanyl, Heroin, Cocaine, Xyalazine, methamphetamine and Tramadol. Nine counts were dismissed.

David M. Cassada, 39, of Sidney, was sentenced to five years community control, with no days of jail credit granted, on one count having weapons while under disability, a third degree felony, one count possession of drugs, a fourth degree felony, and one count trafficking in drugs, a fifth degree felony. Additionally, Cassada must successfully complete drug and alcohol counseling, must maintain employment, must successfully complete Thinking for a Change/Decision Points, and must serve 30 days in the county jail on weekends.

Cassada was indicted on one count having weapons while under disability, a third degree felony, one count aggravated possession of drugs, a fifth degree felony, one count possession of drugs, a fourth degree felony, one count possessing criminal tools, a fifth degree felony, two counts trafficking in drugs, a fifth degree felony, and two counts aggravated possession of drugs, a fifth degree felony, for possession of a 12-gauge H.R. Pump Shotgun and a 9mm pistol handgun while under disability, possession of psilocyn, Fentanyl, pipe, straws, baggies and scales, Oxycodone and Hydrocodone. Five counts were dismissed. The Shelby County Sheriff’s Department is authorized to destroy or otherwise dispose of the 12-gauge H.R. Pump Shotgun and 9mm pistol handgun.

Austin T. Martin, 25, of Sidney, was sentenced to five years community control, with two days of jail credit granted, on two counts trafficking in drugs, a fourth degree felony. Additionally, Martin must successfully complete drug and alcohol counseling, and must successfully complete Thinking for a Change/Decision Points.

Martin was indicted on three counts trafficking in drugs, a fourth degree felony, and one count possessing criminal tools, a fifth degree felony, for Hashish, marijuana, baggies, vacuum sealer, scales, vape cartridges and pipes. Two counts were dismissed. Contraband of $1,157 is forfeited to the Sidney Police Department and the Sidney Police Department is authorized to destroy or otherwise dispose of a 9mm handgun and accessories, two 12 gauge shotguns, an AK-47 rifle, a bullet proof vest, a roku TV, a security camera system, a stack-on gun case, assorted ammunition, gun accessories, marijuana grow tents and growing accessories.

Charlie M. Browning, 23, of Sidney, was sentenced to five years community control, with one day of jail credit granted, on one count trafficking in drugs, a fourth degree felony. Additionally, Browning must successfully complete drug and alcohol counseling, must successfully complete Thinking for a Change/Decision Points, must serve 60 days in the county jail on work release, and must obtain and maintain employment after serving his jail sentence. Browning was indicted on one count trafficking in drugs, a fourth degree felony, and two counts trafficking in drugs, a fifth degree felony, for cocaine. Two counts were dismissed.

Holly A. Cooper, 42, of Sidney, was sentenced to 11 months in prison, with 57 days of jail credit granted, after violating terms and conditions of her community control sanction. Cooper was convicted on one count aggravated possession of drugs, a fifth degree felony, and one count possessing criminal tools, a fifth degree felony, for methamphetamine and glass pipes.

Lyndsey Strunk, 30, of Sidney, was sentenced to five years community control, with no days of jail credit granted, on one count attempted illegal use of supplemental nutrition or WIC program benefits, a first degree misdemeanor. Additionally, Strunk must obtain a GED and must obtain and maintain employment. Strunk was indicted on one count illegal use of supplemental nutrition or WIC program benefits, a fifth degree felony, for using another’s benefit cards in the amount of $576.99.
